HubEurope Ltd – Terms and Conditions (“Terms”)

 

1. Introduction

These Terms and Conditions (“Terms”) apply to the provision of parcel carriage and related services by HubEurope Ltd.

HubEurope Ltd is a trading name of HubEurope Ltd, whose registered office address is Bond Street Chambers, 1 Bond Street, St Helier, Jersey, JE2 3NP (“HubEurope”, “we”, “us”, “our”).

By accessing www.hubeurope.com (“the Website”), placing a Service Order, or using any HubEurope service, you agree to be bound by these Terms, our Privacy and Cookie Policy, your account-specific rate card terms and conditions, and the Terms and Conditions of the selected carrier(s).

If you do not agree to these Terms, you must not use the Website or our Services.

 

2. Contractual Hierarchy

These Terms apply in addition to, and not in substitution for:

  • the account-specific rate card terms and conditions agreed between you and HubEurope; and
  • the Terms and Conditions of the selected carrier(s).
2.1. Order of Precedence

In the event of any conflict:

2.1.1. Mandatory carrier Terms and Conditions shall prevail in respect of carriage, service rules, operational requirements, liability limits and surcharges;

2.1.2. Account-specific rate card terms shall prevail in respect of pricing, volumes, service availability and commercial arrangements;
2.1.3. These HubEurope Terms and Conditions shall apply in all other respects.

 

3. Definitions
  • Additional Compensation: Optional compensation cover purchased by you, subject to carrier limits and exclusions.
  • Agreement: These Terms, the Privacy and Cookie Policy, applicable carrier terms, account rate card terms and any Service Order.
  • Carrier: Any third-party courier or logistics provider used to perform carriage.
  • Charges: All prices, fees, surcharges and costs payable for Services.
  • Parcel: Any item tendered for carriage.
  • Service Order: Any booking, label purchase or shipment instruction placed via the Website, API or platform.
  • You / Your / Customer: The sender, account holder or party placing the Service Order.

 

4. Use of the Website

You agree not to use the Website:

  • for unlawful purposes;
  • to interfere with its operation or security;
  • to access restricted systems or data.

Misuse may result in suspension of access and civil or criminal liability.

 

5. Formation of Contract

A contract is formed when HubEurope accepts a Service Order. Acceptance may be automated or manual and does not guarantee availability of any specific service.

 

6. Charges, Rates and Freight Profile

6.1 All published rates are indicative only.
6.2 Charges are calculated based on the information you provide, including weights, dimensions, contents, destination and selected service.
6.3 You warrant that all shipment data is accurate and complete.
6.4 HubEurope reserves the right to amend Charges where shipment data is incorrect.

 

7. Prohibited and Restricted Items

7.1 Certain items are prohibited from carriage. The current list is available at:

7.2 Parcels containing prohibited items:

  • are carried entirely at your risk;

  • are excluded from compensation, even where Additional Compensation is purchased.

7.3 HubEurope may refuse, return, destroy or dispose of prohibited items and recover any associated costs.

 

8. Surcharges
8.1 Carrier Terms and Conditions

In addition to these Terms, all shipments are subject to the Terms and Conditions of the selected carrier. By using HubEurope services, the Customer agrees to be bound by the applicable carrier’s rules, service specifications, surcharges and operational requirements, which may be amended by the carrier from time to time.

8.2 Declared Weights, Dimensions and Service Selection

Customers are responsible for ensuring that all parcel weights, dimensions, contents and service selections are accurately declared at the time of shipment.

Where a Parcel is found to be under-declared or incorrectly declared, this may result in one or more of the following charges:

  • a re-labelling or service correction surcharge where the Parcel is moved to the correct service;
  • a carrier-imposed surcharge, which may include:
    • the difference in label cost for the correct applicable service; and/or
    • a fixed or variable surcharge applied by the carrier in accordance with its Terms and Conditions.

Both charges may apply.

 

8.3 Passing on of Surcharges

All surcharges applied by carriers are passed on at cost. HubEurope does not mark up carrier surcharges and has no control over their application, calculation or enforcement.

 

8.4 Payment of Surcharges

All surcharges are payable in line with the agreed account terms and will be charged to the Customer’s account or invoiced accordingly.

Payment of surcharges is required regardless of whether a dispute is raised, pending the outcome of any review.

 

8.5 Disputing a Surcharge

To dispute a surcharge, the Customer must:

  • contact the HubEurope Customer Service team within 7 days of notification or invoice;
  • provide supporting evidence (including photographs, measurements or documentation).

HubEurope will raise the dispute with the carrier on the Customer’s behalf.
Where a dispute is accepted by the carrier, a credit will be applied.

All disputes are subject to the carrier’s final decision, which HubEurope cannot overturn.

 

8.6 No Liability for Carrier Surcharges

HubEurope accepts no liability for surcharges resulting from:

  • incorrect or incomplete shipment data;
  • packaging non-compliance;
  • service misuse or misselection;
  • carrier operational or automated measurement systems.

 

8.7 Right to Recover Costs

HubEurope reserves the right to recover any surcharge, cost or fee applied by a carrier, including those identified after delivery.

 

8.8 Best Practice Recommendation

Customers are encouraged to:

  • use calibrated scales and accurate measuring equipment;
  • photograph packed Parcels;
  • allow for packaging in measurements;
  • package items appropriately for the selected service.

 

9. Compensation and Liability
9.1 Liability is limited to the lower of:
  • the carrier’s liability limits; or
  • the Additional Compensation purchased.
9.2 No compensation is payable for:
  • prohibited items;
  • indirect or consequential loss, including loss of profit, revenue or reputation.
9.3 Where Additional Compensation for loss only is purchased, damage is excluded.

 

10. Indemnity

You shall indemnify HubEurope against all claims, losses, damages, costs and legal fees arising from:

  • breach of these Terms, carrier terms or rate card terms;
  • incorrect declarations;
  • prohibited or restricted items;
  • third-party claims.

11. Termination

HubEurope may suspend or terminate Services immediately if you breach these Terms or fail to pay Charges.

Outstanding Charges remain payable on termination.

 

12. Force Majeure

HubEurope is not liable for failure or delay caused by events beyond reasonable control, including weather, strikes, system failures or carrier disruption.

 

13. Assignment

You may not assign this Agreement without prior written consent.

 

14. Severability

If any provision is held invalid, the remaining provisions remain in force.

 

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.
The courts of England have exclusive jurisdiction.

 

16. Acceptance

By placing a Service Order, you confirm acceptance of:

  • these HubEurope Terms and Conditions;
  • your account-specific rate card terms and conditions;
  • the Terms and Conditions of the selected carrier(s).
